This article establishes that the Criminal Code of the Republic of Uzbekistan also protects public relations regarding the safety of life, namely a child. At the same time, this crime differs from intentional murder (Article 97 of the Criminal Code) in that the obligatory signs are that the crime is committed by a biological mother against her newborn child, during childbirth or immediately after them, which is why the legislator provided for this composition as a privileged. The article provides a legal analysis of current article. It was found out that peculiarity of this type of murder is that when a mother commits a crime, the mother giving birth to a child has a special psychophysical state that occurs during childbirth or immediately after them. This condition of the mother can be caused by suffering, pain, anguish that occurs during childbirth, which can cause negative feelings for the child in the mother. The article substantiates the need to specify criminal liability, providing for mental state of a woman in labor as a mandatory feature.
