Analysis of criminal procedure legislation through the prism of justice

In the article, the author aims to investigate the current criminal procedure legislation of the Republic of Uzbekistan based on the criterion of fairness.

The article initially provides an analytical description of the functions and principles of the Code of Criminal Procedure, the main and only law establishing the procedure for conducting criminal proceedings on the territory of our country, the specifics of the amendments and additions made to it in 1995-2023.

At the same time, the current criminal procedure legislation is critically analyzed through the prism of justice, pointing out a number of inconsistencies in it, expressed in maintaining the repressive nature inherent in the legislation of the former Union; dualism, that is, the presence of contradictory provisions; the inclusion of procedural procedures that contradict justice; the presence of procedural processes that still It is more complicated to conduct criminal cases, as well as the fact that he also has serious criminal procedural loopholes.

Special emphasis is placed on the fact that the fair conduct of criminal cases is one of the most important factors directly contributing to improving the effectiveness of anti-crime activities.
