Abstract

This article examines the historical development of the institution of suspension and resumption of criminal proceedings, along with its legal nature and significance within the criminal procedural system. It underscores that during the implementation of the Judicial Statutes of 1864 in the Turkestan region, legal mechanisms were established concerning the powers of judicial authorities, the search for accused individuals, and the suspension of criminal proceedings. The article emphasizes key principles of legal institutions, such as judicial independence and the presumption of innocence. Furthermore, it highlights the critical role this institution plays in upholding the rule of law, ensuring the fair adjudication of criminal cases, and promoting the effective functioning of the law enforcement system.
