The Concept of Developing a Permitting Code: Theoretical Foundations and Practical Approaches

This article provides a scientific justification for the necessity of adopting the Permitting Code of the Republic of Uzbekistan as a comprehensive and foundational legal act encompassing all aspects of permitting activities. It analyzes the legal, institutional, and procedural issues in the existing permitting system, including the multiplicity and fragmentation of regulatory legal acts, the absence of unified standards, lack of digital integration, and ineffective mechanisms for protecting applicants' rights. The article clarifies the goals and objectives of codification, the subject of legal regulation of the future Code, the range of entities to which it applies, and the proposed innovative mechanisms, including the introduction of "tacit consent," a digital registry, standardization of procedures, and mandatory pre-trial appeals.

The article identifies the patterns of the Code's systemic role in the structure of administrative, business, and sectoral legislation, as well as its legal, social, economic, and political implications. It establishes the significance of the Permitting Code for developing a modern model of the permitting system that aligns with the principles of open governance, digitalization, and legal certainty. The article concludes that the adoption of the Code will mark an important stage in the institutional modernization of Uzbekistan and will help strengthen trust between the state, business, and civil society.
