Based on a comprehensive legal analysis, this article examines the content, scope, and prospects for harmonizing two international doctrines that are significant in contemporary construction law—the Quantum Meruit doctrine and the Spirin doctrine—and assesses their compatibility with Uzbek civil law. The Quantum Meruit doctrine is considered as the national-law analogue of unjust enrichment in relation to Articles 1023–1030 of the Civil Code. The Spirin doctrine, understood as a principle for allocating liability for defects or errors in design documentation provided by the client, is related to Article 633 (risk of accidental loss), Articles 686–692 (contract law provisions) of the Civil Code of Uzbekistan, and to applicable standards governing the quality of design documentation.
The article develops regulatory proposals required for applying these doctrines in national construction-law practice and substantiates the need to create a coherent system for equitable risk allocation between parties in construction projects.
